الملخص

تربط هذه الدراسة بين علمي الأصول والفقه عند الإمام أبي الوليد الباجي، وذلك من خلال طرح مسألة النهي وما يصرفه عن ظاهره من قرائن، وهي مسألة تناولها الإمام الباجي تأصيلاً في كتابه (إحكام الفصول)، وبث تطبيقاتها في ثنايا كتابه (المنتقى شرح الموطأ).

ولما كانت القرائن الصارفة مبثوثة في المنتقى، كان من المناسب اتباع منهجين أساسيين في هذا البحث، المنهج الوصفي القائم على استقراء القرائن التي استعملها الإمام الباجي في صرفه للنهي عن ظاهره، والمنهج التحليلي المتمثل في تحليل أسباب صرف النواهي عن ظاهرها.

وقد جاء هذا البحث مقسماً على ثلاثة مباحث، الأول منها كان في ترجمة الإمام أبي الوليد الباجي، ذكرت فيه نشأته ورحلته في الطلب العلم ومكانته بين العلماء ، والمبحث الثاني في بيان مفهوم القرينة الصارفة ووظيفتها ومفهوم النهي ودلالته عند الأصوليين ، وأما المبحث الثالث فقد بيّنت فيه القرائن التي استعملها الإمام الباجي في صرفه للنهي عن ظاهره، وذلك بعد استقراء كتابه المنتقى شرح الموطأ.

وقد خلصت الدراسة إلى أن القرائن الصارفة للنهي عن حقيقته عند الإمام الباجي هي: فعل النبي صلى الله عليه للمنهي عنه، وإقراره لمن فعله، وفعل الصحابة رضي الله عنهم للمنهي عنه، والقياس.
