التعسف في استعمال الحق وأثره في باب الوليمة

لقد تناول الباحث في هذه الدراسة عن التعسف في استعمال الحق وأثره في باب الوليمة ، ولا شك بأن باب الوليمة من الأمور المهمة التي يستعملها الناس في حياتهم اليومية ، وهي من أبرز سبل النكاح ، فمن هذا المنطلق تناول الباحث هذه الدراسة وقسم هذه الدراسة الى مبحثين ويندرج تحتها مطالب ، حيث تطرق في المبحث الأول الى تعريف التعسف والحق لغة واصطلاحاً ، وذكر الأدلة على التعسف من القران والسنة وآثار الصحابة والأصول التشريعية والقواعد الشرعية ، وكذلك ذكر الباحث معايير نظرية التعسف في استعمال الحق ،والجزاء المترتب على التعسف ، وأما المبحث الثاني فقد تطرق الباحث الى تعريف الوليمة في اللغة والاصطلاح ، وذكر مشروعية الوليمة وحكم إجابتها ، وبين الباحث التعسف في استعمال الحق في باب الوليمة .
وقد خلصت هذه الدراسة الى أن المقصود من التعسف هو مناقضة قصد الشارع في تصرف مأذون فيه شرعاً بحسب الأصل، وأن معايير التعسف تنقسم الى قسمين وهما المعيار الذاتي والمعيار الموضوعي، وأن المعيار العام الذي ينتظم المعايير : هو استعمال الحق في غير ما شرع له، وأن التعسف في استعمال الحق يدخل في باب الوليمة.
